Landlord hasn’t paid the mortgage? Know your tenant rights in event of power of sale
Toronto Star
If your landlord defaults on their mortgage, your tenant rights depend heavily on your province. In Ontario, you are heavily protected: lenders must honor your existing lease during a power of sale, and a new buyer can only evict you if they intend to move in themselves, which requires 60 days' notice and one month's rent as compensation. However, in British Columbia, court foreclosure orders take precedence over residential leases, meaning your tenancy could end immediately on very short notice. Regardless of location, experts advise tenants to continue paying rent on time—directly to the lender if officially requested—document all communication, and consult local tenant laws immediately upon receiving a bank notice.
